2011 Cornerstone Casework: Polsinelli Shughart PC

This case resolved a decades-old annexation issue involving the Western Taney County Fire Protection District and the city of Branson, after the issue had wound its way through three Missouri courts, including the Missouri Supreme Court. Polsinelli Shughart attorneys Jay Dade and John Holstein represented the city after the district sued for additional fees as a result of annexation by the city. The city maintained that all fees were satisfied following a 1994 agreement between the parties. The city’s position was that under the agreement, the city fully compensated the district for post-1994 annexations through a payment of $1.2 million spread over three annual payments through 1997. After oral arguments on Jan. 11 of this year, the Court of Appeals accepted the city’s position, ruling that the Missouri statute did not supersede the parties’ 1994 agreement. The Missouri Supreme Court subsequently denied transfer of the case.
