2011 Cornerstone Casework: Husch Blackwell LLP

This case, in Greene County Circuit Court, was a sexual harassment and retaliation case brought by two plaintiffs against Archer Western Contractors Ltd. and two supervisors. The husband-and-wife plaintiffs were both employed by Archer Western, and they claimed that the husband’s reporting of alleged sexual harassment resulted in the subsequent layoff of both plaintiffs. The plaintiffs alleged an agency theory of retaliation for the female plaintiff. The plaintiffs’ petition alleged sexual harassment against Archer Western’s Springfield project manager, who the plaintiffs claimed sexually harassed the female plaintiff, and retaliation against the supervisor to whom the plaintiffs claimed the husband reported the alleged harassment. Prior to trial, the plaintiffs dismissed the sexual harassment claim against Archer Western and dismissed the alleged harasser from the case. Following a four-day trial, the jury deliberated for 25 minutes and returned a full defense verdict for Archer Western and the remaining individual defendant.
