Tracy Morgan sues Wal-Mart over I-95 crash

Posted online
When does a 700-mile work commute end in court? When the driver forced to make the trek from Georgia to Delaware to clock in, crashes into a line of slowed traffic and kills and injures celebrities.

That's what happened on June 7, when a Wal-Mart truck driven by Kevin Roper slammed into a vehicle carrying comedians home from a show. Comedian James McNair was killed in the accident on I-95 and three others, including comedian Tracy Morgan, were seriously injured.

Now Morgan is suing Wal-Mart Stores Inc., which employed the driver. The lawsuit accuses the retailer of "negligence and reckless conduct" for making Roper commute 700 miles from his home in Georgia to a Wal-Mart distribution center in Delaware, then clock in and begin his shift.

The suit notes there are multiple Wal-Mart facilities closer to Roper's home, including nine in Georgia. The driver, who had not slept for more than 24 hours before the crash, is not named in the lawsuit.
