Springfield home dealer charged again for alleged fraud

A Springfield manufactured homes dealer is under fire for the second time this year after Missouri Attorney General Jay Nixon received more consumer complaints about the company’s business practices.

Nixon has filed an amended petition against Michael and Kay Jackson, owners and operators of Dogwood Homes, 3800 W. Sunshine St.

It is Nixon’s second request for injunctions this year against the company.

Past trouble

Nixon first filed a lawsuit against the Jacksons in April, alleging Dogwood accepted thousands of dollars in payment to deliver a modular home to a consumer and then did not meet the promised delivery dates, and alleging the company did not provide a promised $500 refund to a Wisconsin man. As part of that court order, the company delivered the home and refunded the Wisconsin man.

Today’s petition, filed in Greene County Circuit Court, calls attention to the latest consumer complaints against Dogwood.

Nixon says one consumer paid Dogwood $36,000 for a home in mid-March and, when that home was not available, he signed a second contract in April for a different home for the same price.

The consumer has not received the home.

Other complaints cite Dogwood’s alleged failure to pay sales tax on a home sold to a consumer, failure to deliver titles to homes purchased by consumers and failure to complete the promised setup of consumers’ homes.

In addition to restitution for the consumers, Nixon is asking the court to issue preliminary and permanent injunctions against the Jacksons to prohibit them from violating state consumer laws, including false advertising.

The suit also requests injunctions that require the defendants to acquire and maintain performance bonds of at least $300,000 before advertising or selling manufactured homes, and to present a copy of those injunctions to any consumer or business they come in contact with.
