The suit is against James Andrews, who does business as Gold Exchange, 1027 W. Kearney.
Nixon is seeking a temporary restraining order to stop Andrews from advertising or conducting the sale without following state law.
Law requires that businesses notify the attorney general’s office 10 days before conducting a going-out-of-business sale and to submit an inventory of items that will be offered. The law also says the inventory cannot be supplemented after the sale begins, and the sale cannot last more than 60 days unless the attorney general grants an extension.
In addition to the restraining order, the suit, filed in Greene County Circuit Court, requests Andrews register his business with the Missouri Secretary of State.
A hearing is scheduled for 9:30 a.m. Tuesday.
