Workers Compensation Second Injury fund is nearly out of money and under pressure from trial attorney aggressive tactics. Last statistics I heard was that attorney fees accounted for 40 percent of all claims paid and 60 percent in St. Louis, thus, depriving genuinely injured workers of needed care. Failure to solve the issue will result in unacceptable surcharges to small businesses, which even though they are doing a good job of avoiding injuries, will be forced to pay for others’ malfeasance.
