Nixon’s office has obtained $20,000 for member refunds from a letter of credit submitted by the spa’s owners, according to a news release.
Health spas in Missouri must provide proof of either a bond or a letter of credit to the attorney general’s office when they open. The bond or letter of credit then is used to provide refunds, if the health spa closes, for consumers who pay for membership fees in advance and a suitable alternative is not provided to those members. Money for consumers is paid out of the Health Spa Regulatory Fund.
Nixon said the owners of Club Nutrition and Fitness have cooperated with his office in order for the letter of credit to be used for refunds.
Eligible consumers need to file a formal complaint with Nixon’s office for their refunds to be processed. The deadline to apply for refunds is July 21.
Documentation that membership fees were paid in advance needs to be provided. Complaints may be filed online at www.ago.mo.gov; forms also may be obtained by calling the Consumer Protection Hotline at (800) 392-8222.
Club Nutrition and Fitness opened in July 2004.
In 2006, Walker contracted with Bloomington, Ill.-based Now Foods to produce 12 custom supplements for his company. Attempts to reacher Walker for this story were unsuccessful.
