The Kansas Supreme Court is scheduled to hear oral arguments today as part of a constitutional showdown concerning the state’s school finance system, according to the
Lawrence Journal-World.
Cuts to the state budget since 2008 have wiped out court-mandated increasing in public school funding that stemmed from a 2005 case, Montoy v. Kansas. In that case, Kansas legislators were found to have violated their constitutional duty to provide adequate funding for public schools before they implemented school budget increases.
A decision in favor of the plaintiffs, who are seeking additional funding for schools, could result in a constitutional showdown as many lawmakers are said to believe the court overstepped its authority with the previous case.
