A Wyandotte County, Kansas, judge on Friday dismissed a wrongful death suit in a case involving the Verruckt water slide at Schlitterbahn Waterpark in Kansas City, Kansas.
The suit was filed after the death of Caleb Schwab, 10, who was decapitated when the raft he was riding went airborne, causing him to hit his head on a metal support bar.
Schlitterbahn co-owner Jeffrey Henry, Verruckt co-designer John Schooley and New Braunfels, Texas-based Henry & Sons Construction Co. had been charged with second-degree murder, aggravated battery and aggravated child endangerment.
