U.S. District Judge Roy Altman in Miami rejected Burger King's request to dismiss a lawsuit related to the apparent size of its Whopper sandwich in ads.
A class-action lawsuit alleges the company's depiction of Whoppers on in-store menu boards can mislead reasonable customers into thinking they'll get more food than they pay for.
The class-action suit is pursuing negligence-based and unjust enrichment claims.
