St. Louis-based Express Scripts, one of the largest pharmacy benefit managers, has filed suit against the Federal Trade Commission.
The suit takes issue with an FTC report in July that said market consolidation has led to PBMs favoring their own affiliated businesses.
Express Scripts, which is seeking an order for the FTC to take down the report, alleges the agency did not take into account evidence that PBMs provided and instead relied on public comments.
