Courts to decide if FedEx Ground drivers are employees

Hundreds of former and current drivers are suing FedEx subsidiaries for back pay for overtime and to recoup deductions paid for work expenses, such as uniforms, equipment and truck maintenance. If history repeats, odds are not in their favor to win.
 
Since 2009, drivers in several states have sued and the courts have sided with FedEx, which considers the drivers independent contractors.
 
But in August, the U.S. Ninth Circuit Court of Appeals in San Francisco sided with drivers in California and Oregon. Kansas courts also ruled in favor of the drivers in October, which will allow many cases to be reheard. Bloomberg Businessweek reports this could slow or even halt the trend of companies treating workers as contractors instead of employees.
