Contract clauses calling for disputes to be settled through arbitration opposed to in open court are becoming more common in the Natural State, according to Arkansas Business.
While it is hard to quantify the trend due to the private nature of arbitration, contract clauses are popping up more frequently in senior living care contracts, cellphone agreements and credit card documents.
The clauses, which are often tucked into large agreements, can benefit companies trying to avoid potential jury trials, but can blindside consumers who don’t realize they are signing away their right to seek remedies for civil claims.
