AG Nixon files suit against N.C. time-share firm

Missouri Attorney General Jay Nixon has filed a lawsuit against a North Carolina-based time-share company for misleading its Branson customers.

Nixon filed suit Nov. 22 in Taney County Circuit Court against Festiva Resorts LLC, which sells time shares at the Cabins at Green Mountain in Branson.

The suit alleges Festiva violated Missouri consumer protection laws by misleading customers into buying time shares.

The suit says the company made several false promises to customers, including:

• help with selling other time shares the customers owned;

• help renting out time shares purchased from Festiva;

• help getting good deals on condominium rentals in attractive locations;

• help getting good deals on vacation packages; and

• refunds for those dissatisfied with their purchases.

Nixon also said Festiva failed to give customers enough time to make decisions, creating a high-pressure sales environment.

“This kind of lawsuit is intended to punish those who give Branson a bad name and put other abusers on notice that we’re watching them,” Nixon said in a news release.

The suit asks the company to refund $200,000 to its misled customers, pay fines of up to $1,000 per violation of the law and reimburse the state for its investigative and legal costs.
