Alabama pharmacy sues Express Scripts for terminating contract

A Daphne, Ala., pharmacy is accusing pharmacy benefits manager Express Scripts of unfairly terminating their provider agreement.

Triad Rx Inc. alleged the breach of contract in a suit filed Friday against the St. Louis company, according to the St. Louis Business Journal.

The lawsuit alleges that while Triad and Express Scripts entered a pharmacy provider agreement this spring, Express Scripts said it would terminate the agreement in July, a point of contention.

Express Scripts told Triad it was terminating their agreement because the pharmacy “waived or discounted copayments.” Triad said it accepts payment coupons on behalf of members through Medhealth’s Compound Rx Patient Care Program, but that the practice is authorized by its agreement with Express Scripts.
