Former Bolivar biz owner ordered to pay penalties in state lawsuit

A former Bolivar business owner has been ordered to pay penalties and cease selling construction services in Missouri through a court order in a lawsuit brought by state Attorney General Eric Schmitt.

A ruling filed Dec. 27 in Polk County Circuit Clerk by 30th Judicial Circuit President Judge Michael O'Brien levies hundreds of thousands of dollars’ worth of restitution payments and penalties against Jerry Shane Fellers, according to court documents. The court order was signed by the judge on Dec. 22.

Through Build Tech Structures Inc., Fellers failed to provide promised construction services to customers and to provide refunds, according to an October complaint from Schmitt's office. The attorney general's lawsuit alleged Fellers accepted nearly $270,000 for constructions services he did not complete.

Build Tech Structures, which built pole barns, is no longer listed as an active business with the Missouri secretary of state.

Fellers currently resides in the F. DeWayne Beggs Detention Center in Norman, Oklahoma, according to court records. He's serving time there on similar charges unrelated to Schmitt’s case, according to KY3 reporting.

In the court judgment filed this week, Judge O'Brien ordered Fellers to pay $301,751 as restitution to victims, $30,175 to the state's Merchandising Practices Revolving Fund and $27,000 in civil penalties.
