Swisshelm hearing today canceled, to be rescheduled

Former restaurateur Bruce Swisshelm will wait longer to be resentenced for bank fraud and money laundering.

A hearing scheduled for 9 a.m. today was canceled because of a court schedule conflict.

“Chambers will contact counsel for a new date as soon as possible,” reads a court notice signed by Judge Brian Wimes of the Western District of Missouri.

Last month, acting U.S. Attorney for the Western District of Missouri Tom Larson recommended the U.S. Court of Appeals for the Eighth Circuit impose a sentence of 71 months, or nearly six years, in prison when the June 6 hearing was set, according to court documents.

Swisshelm originally was sentenced in January 2016 to one year and one day in prison for the $5.6 million fraud scheme related to the submission of false documents to Great Southern Bank to receive four commercial loans between February and June 25, 2011. He also was ordered to pay restitution.

In February, the Court of Appeals for the Eighth Circuit ruled Swisshelm must be resentenced because his defense team argued for a lesser sentencing than agreed in his plea deal. His agreement included an advisory range of 57-71 months in prison, and by arguing for lesser time in prison, Swisshelm violated the terms of the plea agreement, according to the court’s ruling. The decision removed Swisshelm’s previous sentence, according to Springfield Business Journal archives.

Swisshelm in 2012 filed bankruptcy, setting off a string of closures that included Macaroni Grill and the south-side Ebbets Field.
