Indian Ridge parcel headed to auction

A 25.17-acre parcel of the Indian Ridge Resort Community development in Branson West is headed to a court-ordered auction July 30.

Foster Auction & Appraisal Service of Crane has been enlisted to auction a portion of the development that has 80 lots, 13 structures in various stages of completion for 26 condominiums, more than 400 feet of Highway 76 frontage and a double-sided billboard, according to the auction listing.

Foster Auction owner Larry Foster said the auction was ordered in June by Stone County Circuit Court. The starting bid for the absolute auction will be $550,000.

According to Stone County Circuit Court documents provided by Foster, the sale of the parcel would satisfy liens filed by 10 companies against the property owner, Denver-based North Shore Investments LLC, a company that purchased land from Indian Ridge Resort Inc. and its owner Jim Shirato.

The auction is ordered via Jimmy Jones Excavation Inc. v. Western Site Services LLC, et al. According to court records, Western Site Services was formed by North Shore principal owners Don Snider and David Drake to develop the parcel.

According to court documents, Jimmy Jones Excavation Inc. performed labor and work on every lot in the parcel by providing machinery and labor for excavation work. Jimmy Jones filed a lien in November 2008 and six months later filed suit against Western Site Services. The court in April ruled in favor of Jimmy Jones Excavation Inc. to the tune of $157,684 in unpaid work costs, plus 18 percent interest.

According to court records, the court also ruled in favor of:
  • Heartland Wood Products Inc.;
  • Brian Sides;
  • JDC Structural Concrete LLC;
  • Rapid Plumbing LLC;
  • Legacy Stairs Inc.;
  • Dyke Industries of Springfield Inc.;
  • Meek Lumber Yard Inc.;
  • Tablerock Asphalt Construction Co.; and
  • Trec Electric Inc.
Shirato broke ground in 2005 on the $1.6 billion, 850-acre Indian Ridge development in Stone County. Shirato, who could not be reached for comment by deadline, previously told Springfield Business Journal project funding was frozen after Topeka, Kan.-based The Columbian Bank and Trust Co. was shut down by federal regulators in August 2008.

In March, Shirato and Snider were sentenced in federal court for violations of the Clean Water Act. A lawsuit had claimed that between August 2006 and June 2009 the developers failed to abate, control or slow erosion from the site construction, which had disturbed roughly 600 acres of land southeast of Highway 76 and Highway 13.[[In-content Ad]]
